Terms of use
1. Provider and scope
The mobile application "BONE" ("App") is provided by Waystar ROYCO GmbH, Grellstraße 37, 10409 Berlin, Germany ("we", "us"). Full provider information is available in the Imprint.
These terms of use govern the contractual relationship between you ("User") and us regarding the use of the App. By registering, you agree to these terms.
2. Minimum age and access requirements
- Use of BONE is restricted to persons aged 18 and over.
- When registering, you confirm that you are at least 18 years old and have full legal capacity.
- Only one account per person is permitted.
3. Conclusion of contract
By completing registration, you submit an offer to enter into a usage contract. We accept the offer by activating your account. The contract is concluded only at that point.
4. Services provided by BONE
We provide a platform that lets you discover, message and connect with other users. Chat contents are end-to-end encrypted between users' devices; we cannot read them in plain text.
We offer basic functions free of charge as well as paid premium functions. The type, scope and pricing of the premium functions available at any time are shown in the App and may evolve.
We make no guarantee of continuously error-free and uninterrupted availability of the App. Maintenance, technical issues or adjustments can cause temporary limitations.
5. Advertising
We may display advertising in parts of the App. Delivery may be personalised based on general profile attributes (e.g. approximate location, app language). We do not pass personally identifying identifiers to ad networks. Details on data processing are in our Privacy Policy. Paid premium functions may reduce or disable ad delivery.
6. Purchases via the App Store
Paid features are purchased exclusively through the Apple App Store. Apple Inc. is the contractual partner for processing the purchase; their terms of service apply additionally. For complaints about individual purchases (e.g. service not rendered, chargebacks) please contact Apple directly first.
7. Right of withdrawal
As a consumer, you generally have a statutory right of withdrawal of 14 days.
For paid digital content delivered immediately upon purchase, the right of withdrawal expires upon commencement of contract performance, provided you have expressly consented to immediate performance and confirmed that your right of withdrawal expires as a result. We obtain this consent prior to purchase.
8. User obligations and conduct
Our Community Guidelines apply to your interactions on BONE. In particular, you agree:
- not to post unlawful, harmful to minors, glorifying violence, discriminatory or harassing content;
- not to post content for which you do not hold the necessary rights;
- not to place commercial content (in particular sex-work solicitations, third-party product advertising) on your profile;
- not to share your access credentials with third parties.
9. Content and rights
You retain all rights to the content you post (profile, photos, texts). You grant us the non-exclusive right, limited in territory and time to the duration of your use, to technically process such content within the App, display it to other users according to your visibility settings, and create copies necessary for providing the service (e.g. caching, backups).
10. Suspension and termination
You may terminate your usage relationship at any time without giving reasons by deleting your account in the App settings. Data is deleted or anonymised in accordance with the Privacy Policy.
We may temporarily suspend or permanently delete accounts in case of serious or repeated violations of these terms or the Community Guidelines. For particularly serious violations — such as the distribution of child sexual abuse material, serious threats of violence or doxxing — suspension is immediate and without warning. Premium credits already purchased forfeit without claim for refund in such cases.
11. Liability
We are liable without limitation for damages arising from intent or gross negligence, for injury to life, body and health, and under the provisions of the German Product Liability Act.
For slight negligence we are only liable for breach of essential contractual obligations (cardinal duties), limited in amount to the typical foreseeable damage. Otherwise liability for slight negligence is excluded.
BONE is a technical platform — we are not an emergency service or law-enforcement agency. The safety features available in the App (e.g. Check-In, emergency contacts) are auxiliary tools and replace neither your own caution nor the relevant public emergency services.
12. Data protection
Processing of your personal data is subject to our Privacy Policy.
13. Changes to these terms
We may adjust these terms where this is necessary for legal, technical or economic reasons and the adjustment does not unreasonably disadvantage you. We will inform you about changes at least 30 days before they take effect, via the App. If you do not object within that period, the amended terms are deemed accepted. If you object, the contractual relationship ends at the time the changes take effect.
14. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer residing in another EU country, the protection of mandatory consumer-protection provisions of your country of residence remains unaffected.
The place of jurisdiction for disputes arising from or in connection with this contract is Berlin, insofar as you are a merchant, legal person under public law, or special public-law fund, or do not have a general place of jurisdiction in Germany.
Should any provision of these terms be or become invalid, the validity of the remaining provisions is unaffected.
